In recent years, the Medicare appeals process has experienced an unprecedented and sustained increase in the number of appeals. At the Office of Medicare and Hearings and Appeals (“OMHA”), the number of requests for an Administrative Law Judge (“ALJ”) hearing or review increased 1,222 percent from fiscal years FY 2009 through FY 2014.1
